Terms of Service for Wakeout for Teams Corporate Wellness App

Wakeout LLC ("Wakeout") welcomes you. We invite you to access and use our company wellness softwater, which we refer to as the "Wakeout for Teams" ("App").

We provide visitors ("Visitors") with access to the App subject to the following Terms of Service, which may be updated by us from time to time without notice to you. By browsing the public areas or by accessing and using the App, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy, which is hereby incorporated by reference (collectively, this "Agreement").

If you do not agree to any of these terms, then please do not use the App.

App Access

You need to be at least 18 years old to access or use the App. By accessing or using the App, you represent and warrant that you are at least 18 years old.

Subscriptions and Payments

Subscriptions to the App automatically renew. You agree that your account will be subject to this automatic renewal feature. If you do not wish your account to renew automatically, or if you want to change or terminate your subscription, please log in and go to the "Billing" page on your "Dashboard" and click on "Manage Plan" to cancel.

Refunds: 30-day money-back Guarantee

We offer a 30-day money-back guarantee. If you are not satisfied with the App for any reason, please contact our customer service team at hello@wakeout.co within 30 days of your initial purchase and we will provide a full refund, minus Stripe Fees.

The 30-day period starts from the initial billing period.

Liability

Although Wakeout is designed for all fitness levels and ages 18 and up, some users may have special needs. Please consult a doctor of physical therapist and verify if Wakeout is right for you. Wakeout is not liable for any injuries that users may incur while using the App. Users use the App at their own risk.

Feedback

We welcome and encourage you to provide feedback, comments and suggestions for improvements to the App ("Feedback"). You may submit Feedback by emailing us at hello@wakeout.co.

Modifications to the App

Wakeout reserves the right to modify or discontinue, temporarily or permanently, the App (or any part thereof) with or without notice. You agree that Wakeout will not be liable to you or to any third party for any modification, suspension, or discontinuance of the App.

User Conduct Guidelines for Wakeout for Teams

As a user of Wakeout for Teams, you agree to refrain from the following actions:

1. Submitting any content that: (i) infringes upon or violates third-party intellectual property rights or privacy rights; (ii) breaks any law or regulation, or incites others to do so; (iii) is fraudulent, false, misleading, or deceptive; (iv) is defamatory, obscene, vulgar, or offensive; (v) encourages discrimination, bigotry, or harm towards any individual or group; (vi) promotes violence or threatening behavior; or (vii) supports illegal or harmful activities or substances.
 
2. Using Wakeout's name, logos, designs, or any part of our services without express written permission from Wakeout LLC.
 
3. Accessing or tampering with non-public areas of our services, our computer systems, or the delivery systems of our service providers.
 
4. Attempting to test the vulnerability of our systems or networks, or to breach our security measures.
 
5. Bypassing any technology we use to protect our services.
 
6. Using any software, tools, or methods (other than those provided by Wakeout or generally available web browsers) to access or search our services, or to download content from our services.
 
7. Sending any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, or other form of solicitation.
 
8. Using Wakeout's trademarks, logos, URLs, or product names without express written consent from Wakeout LLC.
 
9. Using our services for any commercial purpose, for the benefit of any third party, or in any manner not permitted by these Terms.
 
10. Forging any TCP/IP packet header or any part of header information in any email or posting, or using our services to send altered, deceptive, or false source-identifying information.
 
11. Attempting to decipher, decompile, disassemble, or reverse engineer any software used to provide our services.
 
12. Interfering with, or attempting to interfere with, the access of any user, host, or network, including, but not limited to, sending a virus, overloading, flooding, spamming, or mail-bombing the services.
 
13. Collecting or storing personally identifiable information from our services from other users without their express permission.
 
14. Misrepresenting your affiliation with any person or entity.
 
15. Violating any applicable law or regulation.
 
16. Encouraging or enabling any other individual to engage in any of the activities prohibited in this section.

Although Wakeout is not obligated to monitor the use of our services or to review or edit any content, we reserve the right to do so to ensure compliance with these Terms and to comply with applicable law or other legal requirements. We may remove or disable access to any content that we consider, at our sole discretion, to be objectionable or in violation of these Terms. We may investigate violations of these Terms or conduct that affects our services and cooperate with law enforcement authorities in prosecuting users who violate the law.
